قالَ ابنُ شِهابٍ: «ولا أَدري، أَبَعْدَ الثَّالِثَةِ أَوِ الرَّابِعةِ».
ابن شہاب کہتے ہیں کہ میں نہیں جانتا کہ آیا تیسری دفعہ کے بعد بیچنے کا حکم دیا یا چوتھی دفعہ کے بعد۔
Ibn Shihāb said: "I am not sure whether the order to sell her is after the third or the fourth time."

Explanation تشریح
نبی ﷺ سے اس باندی کی حد کے بارے میں دریافت کیا گیا جو محصنہ نہ ہو یعنی غیر شادی شدہ ہو اور زنا کر لے۔ نبی ﷺ نے بتایا کہ اسے کوڑے لگائے جائیں اور اسے لگائے جانے والے کوڑے آزاد عورت کی حد سے نصف ہوں گے یعنی پچاس کوڑے، کیوں کہ اللہ تعالیٰ کا فرمان ہے ’’ فَإِذَا أُحْصِنَّ فَإِنْ أَتَيْنَ بِفَاحِشَةٍ فَعَلَيْهِنَّ نِصْفُ مَا عَلَى الْمُحْصَنَاتِ مِنَ الْعَذَابِ‘‘ (النساء:25)۔ ترجمہ:" پس جب یہ لونڈیاں نکاح میں آجائیں پھر اگر وه بے حیائی کا کام کریں تو انھیں آدھی سزا ہے اس سزا سے جو آزاد عورتوں کی ہے"۔ پھر اگر وہ دوبارہ زنا کرے تو اسے پھر پچاس کوڑے مارے جائیں تا کہ وہ بدکاری سے باز آ جائے۔ جب وہ تیسری دفعہ زنا کرے اور سزا اسے برائی سے باز نہ رکھ سکے اور نہ ہی وہ اللہ کے حضور تائب ہو اور تمھیں رسوائی کا ڈر ہو تو اس صورت میں اس پر کوڑوں کی سزا نافذ کر کے اسے بیچ دو اگرچہ کم ترین قیمت یعنی ایک ارزاں رسی ہی کے عوض بکے۔ کیونکہ نہ تو اس کے تمہارے پاس رہنے میں کوئی خیر ہے اور نہ ہی اس کے راہ راست پر آنے کی کچھ امید ہے۔چنانچہ اس کا دور رہنا قریب رہنے سے بہتر ہے تا کہ جس گھر میں وہ رہائش پذیر ہو اس کے بگاڑ کا باعث نہ بنے۔
Explanation
The Prophet (may Allah's peace and blessings be upon him) was asked about the corporal punishment prescribed by Shariah for the crime of fornication committed by the unmarried slave girl. So, he replied that she should be flogged, and she deserves to be flogged half the number of times that the free woman receives when committing fornication, which is fifty whips, as Allah, the Almighty, says: {When they are married, if they should commit adultery, they receive half the punishment of free women} [An-Nisā’: 25]. If she fornicates a second time, she should be flogged again fifty times to be deterred from committing this sin again. If she fornicates for the third time and is not deterred by that punishment and does not repent to Allah, the Almighty, and it is feared that she would do it again, then she should be flogged and sold, even at the least price, which is a cheap rope only. This is because there is no good in keeping her and there is no hope in her becoming upright, and her being far away is better than her being close so as not to be a cause of evil in the house where she resides.
